Missouri Medigap Birthday Rule: What Policyholders Need to Know

By:Michael Quinn Published onJune 11, 2026June 12, 2026 Updated onJune 12, 2026

Missouri has been working toward a Medigap Birthday Rule, but as of this writing, the rule is proposed and not yet enacted. If you are a Missouri Medicare Supplement policyholder wondering whether you have birthday rule protections, here is what you need to know.

In this article we’ll discuss:
  • What Is the Missouri Medigap Birthday Rule Proposal?
  • Current Status
  • What Can Missouri Residents Do Right Now?
  • Frequently Asked Questions
  • The Bottom Line

Important: Birthday Rule laws can change. Always verify current status with the Missouri Department of Insurance (insurance.mo.gov) or a licensed Missouri Medicare advisor before making coverage decisions based on this information.

What Is the Missouri Medigap Birthday Rule Proposal?

Several states have enacted laws giving Medicare Supplement policyholders an annual guaranteed-issue window around their birthday to switch plans without medical Underwriting. Missouri has seen legislative interest in enacting a similar protection for its residents.

If enacted, a Missouri Birthday Rule would allow Medigap policyholders to switch to a plan with equal or lesser benefits once per year during a window around their birthday — without health questions and without the risk of being denied or charged more due to health conditions.

Current Status

Missouri’s Birthday Rule is proposed but not yet in effect as of the last update to this article. The Missouri legislature has considered this type of protection but had not passed it into law as of our most recent review.

To verify the current status: Contact the Missouri Department of Insurance at 1-800-726-7390 or visit insurance.mo.gov.

What Can Missouri Residents Do Right Now?

Option 1: Medical Underwriting

If you are in good health, you may be able to apply for a new Medigap plan through standard medical underwriting. There is no guarantee of approval, but carriers do approve applicants who pass their health screening. This is worth exploring if your current Premium has risen significantly and you have not had major health events.

Option 2: Guaranteed issue Rights from Qualifying Life Events

Certain life events trigger federal guaranteed issue rights for Medigap:

  • Your Medicare Advantage plan leaves Medicare or stops serving your area
  • You are losing employer or union Group health plan coverage
  • You are leaving a Medicare Advantage plan you joined at 65 during your first year (trial right)
  • Your Medigap insurer goes bankrupt or ends coverage through no fault of your own

Option 3: Stay Informed for When the Rule Passes

If Missouri enacts a Birthday Rule, policyholders will gain the same guaranteed-issue annual window that residents of California, Oregon, Oklahoma, and other states already have. Staying informed means you will be ready to act as soon as the protection is in place.

Option 4: Work With a Licensed Medicare Broker

A licensed broker can review your specific situation — your current plan, your health history, and the carriers available in Missouri — and help you understand what switching options are realistically available to you right now.

Frequently Asked Questions

Does Missouri currently have a Birthday Rule? As of our most recent review, Missouri’s Birthday Rule is proposed but not enacted. Verify current status with the Missouri Department of Insurance.

What if I want to switch Medigap plans in Missouri right now? Without a Birthday Rule, your options are medical underwriting (if your health permits) or a qualifying guaranteed issue event. A licensed Missouri Medicare advisor can review your situation.

What would Missouri’s Birthday Rule look like if passed? Based on similar state laws, it would likely provide a 30 to 63-day annual window around your birthday to switch to a plan with equal or lesser benefits, without medical underwriting.

The Bottom Line

Missouri does not yet have a Medigap Birthday Rule, but legislative interest continues. If you are a Missouri Medigap policyholder looking to lower your premium, your best options right now are exploring medical underwriting (if you are healthy) or working with a licensed broker to identify any guaranteed issue opportunities.

If and when Missouri enacts a Birthday Rule, REMEDIGAP will update this guide immediately.
