What Is the Missouri Medigap Birthday Rule Proposal?

Several states have enacted laws giving Medicare Supplement policyholders an annual guaranteed-issue window around their birthday to switch plans without medical Underwriting. Missouri has seen legislative interest in enacting a similar protection for its residents.

If enacted, a Missouri Birthday Rule would allow Medigap policyholders to switch to a plan with equal or lesser benefits once per year during a window around their birthday — without health questions and without the risk of being denied or charged more due to health conditions.

Current Status

Missouri’s Birthday Rule is proposed but not yet in effect as of the last update to this article. The Missouri legislature has considered this type of protection but had not passed it into law as of our most recent review.

What Can Missouri Residents Do Right Now?

Option 1: Medical Underwriting

If you are in good health, you may be able to apply for a new Medigap plan through standard medical underwriting. There is no guarantee of approval, but carriers do approve applicants who pass their health screening. This is worth exploring if your current Premium has risen significantly and you have not had major health events.

Option 2: Guaranteed issue Rights from Qualifying Life Events

Certain life events trigger federal guaranteed issue rights for Medigap:

  • Your Medicare Advantage plan leaves Medicare or stops serving your area
  • You are losing employer or union Group health plan coverage
  • You are leaving a Medicare Advantage plan you joined at 65 during your first year (trial right)
  • Your Medigap insurer goes bankrupt or ends coverage through no fault of your own

Option 3: Stay Informed for When the Rule Passes

If Missouri enacts a Birthday Rule, policyholders will gain the same guaranteed-issue annual window that residents of California, Oregon, Oklahoma, and other states already have. Staying informed means you will be ready to act as soon as the protection is in place.
