California Medigap Birthday Rule: How to Switch Plans Without Underwriting

California has one of the most generous Medigap Birthday Rules in the country. If you live in California and have a Medicare Supplement plan, you have a 60-day window every year to switch to a different Medigap plan, without answering health questions and without the risk of being denied.

What Is the California Medigap Birthday Rule?

California’s Birthday Rule gives Medicare Supplement policyholders a guaranteed-issue window centered on their birthday each year. During this window, insurance companies cannot ask health questions, require a medical exam, deny your application due to a health condition, or charge higher premiums because of pre-existing conditions.

California’s window: 30 days before your birthday through 30 days after your birthday, a total of 60 days. This is one of the longest windows of any state. Starting before your birthday means you can have new coverage ready to go by the time your old plan renews.

Who Qualifies?

  • Must live in California
  • Must currently be enrolled in a Medigap plan
  • Must apply during your birthday window (30 days before through 30 days after)

The Birthday Rule is for people who already have Medigap and want to switch. First-time enrollees use the federal Medigap Open Enrollment Period at 65.

Which Plans Can You Switch To?

Under California’s Birthday Rule, you can switch to a plan with equal or lesser benefits than your current plan.

The most common use: moving to the same plan letter with a cheaper carrier. Medigap benefits are standardized by law, every Plan G covers the same things regardless of carrier. Only the premium differs.

How Much Can You Save?

Medigap premiums increase with age and carriers raise rates annually. Someone who enrolled in Plan G at 65 may find a different carrier offering the same Plan G for $50 to $100 less per month after 5 to 10 years, $600 to $1,200 in savings annually for identical coverage.

How to Use the California Birthday Rule

Step 1: Mark your window. It opens 30 days before your birthday. If your birthday is August 15, your window is July 16 to September 14.

Step 2: Shop for rates. Contact multiple carriers or work with a licensed Medicare broker who can pull quotes across companies. Benefits are standardized, only premiums differ.

Step 3: Apply during your window. No health questions will be asked.

Step 4: Confirm new coverage before canceling old. Wait for written confirmation with a start date before notifying your current carrier.

Common Questions

Does this apply to Medicare Advantage? No. Medigap plans only.

Can I switch to a plan with higher benefits? No. Equal or lesser benefit plans only. You cannot upgrade from Plan N to Plan G using the Birthday Rule.

What if my health is poor? Carriers must accept your application regardless of health status. That is the whole point of Guaranteed issue.

What if I miss my window? Wait until next year’s window, or check whether a qualifying life event gives you guaranteed issue rights in the interim.
